TERMS and CONDITIONS for THIS AUCTION SALE
1.        All items are SOLD “As Is – Where Is”, with No Exchanges, No Guarantee, No Refunds, and Absolutely No Warranty Expressed or Implied.
2.        The item list descriptions are for simple identification purposes only. NO representations are made as to the correct description, quality, genuineness, authenticity, age, value, and origin expressed or implied. All Buyers shall rely solely on his or her own inspection and judgment when bidding. All Bids and Sales are Final.
3.        ACCEPTABLE PAYMENT:
A.    US Currency w/ No 3% fee.
B.    Bank Transfer (Today) w/ No 3% fee.
C.    Visa - MasterCard - American Express - Discover Credit Cards are accepted w/ No 3% fee.
D.    Checks from Bidders having the Adams & Adams “Preferred Customer” CHECK Approved Card w/ No 3% fee.
E.     Guarantee Bank Letter to: Adams & Adams w/ Auction Date, Guarantee Dollar Payment and Letter Expire Date w/ No 3% fee.
F.      A 3% FEE will be ADDED to ALL other checks WITHOUT A BANK LETTER. If your Invoice Total, including the 3% Fee, Exceeds $ 3,000.01, Two (2) or More Checks WILL Be Required. NO Exceptions.
4.        Failure of Payment: According to (Chapter 2 of the Texas Business & Commerce Code), If a Buyer fails to make Full payment after the completion of this Auction Sale, the Auctioneer may at their discretion, Resale such property at Public or Private sale & the Original Buyer shall be required to pay for any or all expenses incurred, including Attorney Fees.
5.     Full Payment due During or WITHIN 1-Hour after the Completion of Today’s Auction!
6.        Items WILL BE SOLD TIMES the Quantity unless announced by the Auctioneer.
7.        This Auction is subject to the Sales Tax Laws of Texas. Resale Buyers must have your Texas 11-digit # in our file Before you Bid. Click here for Resale Form
8.        Neither the Owner nor the Auctioneer assumes any responsibility for any injuries suffered by yourself and others you may bring on the Auction Premises before, during or after this said Auction Sale.
9. Item Removal: Items will be removed by the time listed on the Item List.
10.     The Buyer and others you may bring on the Auction Site are responsible for any repair or damage to building and property when removing any or all item(s) purchased by you and by others.
11.     No Selling or Trading between Buyers on these Auction Premises during this Auction Sale.
12.     10% Buyer’s Fee Example: You Bid $100.00 + $10.00 Buyer’s Fee = $110.00 + Sales Tax. Exempt Buyer’s are exempt from the State Sales Tax, but NOT THE BUYER’S FEE. A 10% Buyer’s Fee is in effect Today. Please keep this in mind when you bid.
13.     Auctioneer reserves the right to withdraw any item(s) prior to the Auction.
14.     Announced Terms SUPERCEDE Printed Terms.
15.     The Auctioneer may Add, Delete, Combine item(s) and lot(s) for this Auction Sale.
16.     Adams & Adams Staff CAN NOT Load your items, However you will be checked out. Please DO NOT REMOVE, GATHER UP or COLLECT items without your PAID Invoice.
17.     Bid increments are at the discretion of the Auctioneer. We may also accept bids in any increment we feel is in the best interest of our Client and will keep this Auction Sale going smoothly.
18.     Smoking is Prohibited inside Rooms, Buildings, around any Chemicals and Hazardous type material areas.
19.     Adams & Adams Requires Buyers to show Bidders Numbers at the time of each purchase.
20.     This Auctioneer is licensed and regulated by the Texas Department of Licensing & Regulation. Licensure with the Department does not imply approval or endorsement by the State of Texas. The Department of Licensing & Regulation P.O. Box 12157, Austin, TX. 78111, (512) 463-2906. Both the Buyer & Seller are protected by a Recovery Fund that is administered by the Department. Dusty Adams Texas Auctioneer License Number is # 6677 and Jason Wilson Texas Auctioneer License Number is # 13656.
21.     This Auction is being recorded for your Protection.
22.     After an item has been sold and your Bidder’s Number has been called by the Auctioneer, Ownership Title passes from the Seller to the Buyer and you become the new owner of the item even though you may not have paid for the item(s). The item(s) become the full and sole responsibility of the Buyer at this point, and the Buyer assumes all risk of loss and damage. Buyers should pay for and remove or guard their items accordingly. Item removal will continue during and after this sale Auction and will be monitored by our Staff however, Adams & Adams will not be responsible for Theft, Loss or Misplacement. The primary responsibility for each item sold, belongs to Buyer immediately after your bidder’s number is called and you acknowledge this by showing your bidders number.
23. Adams & Adams is an Independent Contractor ONLY and is not responsible for acts of its principal(s) or the Seller(s).
24. Any Consigner with items in this Auction Sale is NOT authorized to bid on or purchase anything belonging to them.
25. Any person attending this Auction Sale is responsible for the Terms & Conditions, both printed and announced by the Auctioneer.
26. Vehicle Titles will be sent to Buyer 7-10 days after check has cleared bank. NO titles will be given Auction Day.
27. Adams & Adams adheres to the Code of Ethics adopted by the Texas Auctioneers and National Auctioneers Associations.

A person cannot bid on a firearm if he/she:

IS UNDER 21 YEARS OLD FOR A HANDGUN
IS UNDER 18 YEARS OLD FOR A SHOTGUN OR RIFLE
IS AN ALCOHOL ABUSER
IS under indictment or information in any court for a crime punishable by imprisonment for a term exceeding one year
IS A convicted of a crime punishable by imprisonment for a term exceeding one year
IS a fugitive from justice
IS an unlawful user of or addicted to any controlled substance;
who has been adjudicated as a mental defective or has been committed to any mental institution
IS an illegal alien
has been discharged from the military under dishonorable conditions
has renounced his or her United States citizenship
is subject to a court order restraining the person from harassing, stalking, or threatening an intimate partner or child of the intimate partner
has been convicted of a misdemeanor crime of domestic violence
